Bathtub Gin & Co. is for everyone. Bathtub Gin & Co. is a safe place to gather, share and celebrate. Bathtub Gin & Co. is not a place for inappropriate, disruptive, or abusive behavior.

We do not allow:

  • Abusive or discriminatory behaviors related to gender, gender identity and expression, age, sexual orientation, disability, physical appearance, race, ethnicity, or religion

  • Deliberate intimidation

  • Harassing photography

  • Sustained disruptions

  • Inappropriate physical contact

  • Visibly intoxicated patrons, performers, or staff

  • Illegal drugs or outside alcohol

  • Carrying or possession of firearms or other weapons

  • Smoking or vaporizing any substance inside or within 25 ft of the entrance

  • Unwelcome sexual attention

  • People under 21 years old

 

All staff, performers, and audience members agree to this code of conduct when they enter Bathtub Gin & Co. Violators are subject to removal without the opportunity for a refund. If you experience or witness a violation of this code of conduct, speak to any staff member and/or contact us. 

WHAT IS A VALID ID?

Identification MUST be valid (not expired) and show:

  • The bearer's date of birth,

  •  The bearer's signature (except US Military ID – see below)

  • A photograph of Bearer


TYPES OF ACCEPTABLE ID:

  • Driver’s License, Instruction Permit, or I.D. Card issued by any U.S. State, U.S. Territory and District of Columbia

  • Driver’s License, Instruction Permit, or I.D. Card issued by any Canadian Province

  • Valid Washington State Temporary Driver’s License

  • U.S. Armed Forces I.D. Card (Encrypted signature acceptable)

  • Merchant Marine I.D. Card issued by the U.S. Coast Guard

  • Official Passport, Passport Card, NEXUS Card

  • Washington State Tribal Enrollment Card (No expiration date required)

Bathtubginseattle.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of bathtubginseattle.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. Bathtub Gin & Co. is a bar Site.

Cancellation/Refund Policy

All Sales are final. If a show is canceled, the tickets you purchased will be automatically refunded to the credit card used to make the purchase. Please allow up to five business days for the refund to post to your account.

Certain services made available via this site are delivered by third-party sites and organizations. International Users

The Service is controlled, operated and administered by Bathtub Gin & Co. from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Bathtub Gin & Co. Content accessed through this site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless Bathtub Gin & Co. its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Bathtub Gin & Co. reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Bathtub Gin & Co. in asserting any available defenses.

 Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

 Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Bathtub Gin & Co.l agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

 Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Cottontail AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

 Termination/Access Restriction

Bathtub Gin & Co. reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Washington and you hereby consent to the exclusive jurisdiction and venue of courts in Washington in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Bathtub Gin & Co. as a result of this agreement or use of the Site. Bathtub Gin & Co.'s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Bathtub Gin & Co.'s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Bathtub Gin & Co. with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Bathtub Gin & Co. with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Bathtub Gin & Co. with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

 

Changes to Terms

Bathtub Gin & Co. reserves the right, in its sole discretion, to change the Terms under which bathtubginseattle.com is offered. The most current version of the Terms will supersede all previous versions. Bathtub Gin & Co. encourages you to periodically review the Terms to stay informed of our updates.

PURPOSE

The purpose of this Privacy Policy is to describe how Bathtub Gin & Co.l, (“Bathtub Gin & Co.”,  “us,” “we,” or “our”) collects, uses and shares information about you through our U.S. online interfaces (e.g., websites and mobile applications) owned and controlled by us, including www.bathtubginseattle.com (collectively referred to herein as the “Site”). WHAT INFORMATION THIS PRIVACY POLICY COVER

This Privacy Policy covers information we collect from you through our Site. Some of our Site’s functionality can be used without revealing any personal information. If you do not use these specific features or services on the Site, then the only information we collect will be “Non-Personal Information” (i.e., information that cannot be used to identify you). WHAT INFORMATION WE COLLECT

We gather two types of information about users through the Site: Non-Personal Information. Web beacons are small graphic files linked to our servers that allow us to track your use of our Site and related functionalities. Cookies and web beacons allow Treefort to serve you better and more efficiently, and to personalize your experience at our Site. Cookies and web beacons are not used to retain Personally Identifiable Information. From time to time we may also use additional typical methods of collecting data. You should be able to control how and whether cookies will be accepted by your web browser. Most browsers offer instructions on how to reset the browser to reject cookies in the “Help” section of the toolbar. If you reject our cookies, many functions and conveniences of this Site may not work properly.

HOW WE USE THE INFORMATION

Non-Personal Information. We use Non-Personal Information to build higher quality, more useful services by performing statistical analyses of the collective characteristics and behavior of our users, and by measuring demographics and interests regarding specific areas of our Site. We may also use it for other business purposes. Government Authorities, Legal Rights and Actions. Treefort may share any information it has about you with various government authorities in response to subpoenas, court orders, or other legal process; to establish or exercise our legal rights or to protect our property; to defend against legal claims; or as otherwise required by law.

In such cases we reserve the right to raise or waive any legal objection or right available to us. We also may share your Personally Identifiable Information when we believe it is appropriate to investigate, prevent, or take action regarding illegal or suspected illegal activities; to protect and defend the rights, property, or safety of Treefort, the Site, our users, customers, or others; and in connection with our Terms of Use and other agreements.

 

Disclosure to Acquirers. Treefort may disclose and/or transfer your Personally Identifiable Information to an acquirer, assignee or other successor entity in connection with a sale, merger, or reorganization of all or substantially all of the equity, business or assets of Treefort to which your Personally Identifiable Information relates.

EXTERNAL LINKS

For your convenience we may provide links to sites operated by organizations other than us (“Third Party Sites”) that we believe may be of interest to you. We do not disclose your Personally Identifiable Information to these Third Party Sites without obtaining your consent. We do not endorse and are not responsible for the privacy practices of these Third Party Sites. If you choose to click on a link to one of these Third Party Sites, you should review the privacy policy posted on the other site to understand how that Third Party Site collects and uses your Personally Identifiable Information.

CONFIDENTIALITY & SECURITY OF PERSONALLY IDENTIFIABLE INFORMATION

We consider the confidentiality and security of your information to be of the utmost importance. We will use industry standard physical, technical and administrative security measures to keep your Personally Identifiable Information confidential and secure and will not share it with third parties, except as otherwise provided in this Privacy Policy, or unless we have good faith belief that such disclosure is necessary in special cases, such as a physical threat to you or others.

Because the Internet is not a 100% secure environment we cannot guarantee the security of Personally Identifiable Information, and there is some risk that an unauthorized third party may find a way to circumvent our security systems or that transmission of your information over the Internet will be intercepted. It is your responsibility to protect the security of your login information. Please note that e-mails and other communications you send to us through our Site are not encrypted.

CALIFORNIA PRIVACY RIGHTS

Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g. requests made in 2012 will receive information regarding 2011 sharing activities).

We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “Shine the Light'' requirements and only information on covered sharing will be included in our response.

INTERNATIONAL PRIVACY PRACTICES

Our websites, including websites directed to residents in countries and jurisdictions outside of the United States, are operated and managed on servers located and operated within the United States. By using and accessing our Sites, residents and citizens of countries and jurisdictions outside of the United States agree and consent to the transfer to and processing of personal information on servers located in the United States, and that the protection of such information may be different than required under the laws of your residence or location.

CHANGING OUR PRIVACY POLICY

Please note that we review our privacy practices from time to time, and that these practices are subject to change. Any change, update, or modification will be effective immediately upon posting on our Site. We will notify you of any material change to this Privacy Policy by posting a notice on our Site’s homepage for a reasonable period of time following such update, and by changing the effective date (located at the bottom of this page). NO INFORMATION FROM CHILDREN UNDER 13

We strongly believe in protecting the privacy of children. In line with this belief, we do not knowingly collect or maintain Personally Identifiable Information on our Site from persons under 13 years of age, and no part of our Site is directed to persons under 13 years of age. If you are under 13 years of age, then please do not use or access this Site at any time or in any manner.

We will take appropriate steps to delete any Personally Identifiable Information of persons less than 13 years of age that has been collected on our Site without verified parental consent upon learning of the existence of such Personally Identifiable Information.
